1. About us and these terms

iconsthecase.com is run by Icons The Case Australia Pty Ltd (ABN 91 636 017 466, 31/5 Taylor Court, Cooroy QLD 4563), trading as Icons The Case ("we", "us", "our"). These terms apply when you use this website or buy from it. Please read them together with our Shipping policy, Refund policy, Privacy policy and Contact information. By placing an order, you agree to these terms.

2. Your legal rights

Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law, or under any other law that cannot be excluded, including the consumer law of the country you live in where it applies to you. If anything in these terms conflicts with those laws, the law wins.

3. Our products

We try to show our products accurately. Colours can look slightly different on different screens, and printed designs may vary a little in colour and placement. Please check the size guide on each product page before you order.

4. Prices and payment

Prices are shown in Australian dollars (AUD) unless another currency is shown for your country. If you pay in another currency, the converted price shown at checkout is the price you pay. Prices include any GST or VAT we are required to charge, unless checkout shows otherwise. Delivery charges are shown at checkout before you pay.

Payment is taken when you place your order and is processed by our payment providers. We do not see or store your full card details.

5. Orders

After you order, we email you an order confirmation. If we cannot supply an item, for example because it is out of stock or was listed at a clearly wrong price, we will tell you and refund you in full for that item. We may also cancel an order we reasonably believe is fraudulent, and refund any payment.

6. Discount codes

Discount codes and promotions are subject to the conditions shown with them. They have no cash value and cannot be combined unless we say so.

7. Delivery

We deliver to the countries listed in our Shipping policy. Items are our responsibility until they are delivered to the address you gave us.

8. Returns, refunds and warranty

Our Refund policy explains what to do if an item is faulty, damaged or wrong, our 2 year warranty, and the 14 day cancellation right for UK and EU customers. We do not offer change of mind refunds, except where the law requires it.

9. Wholesale, distributor and custom orders

Orders for resale, and custom colour, logo or print orders, are covered by the quote or agreement we give you. If that quote or agreement conflicts with these terms, the quote or agreement applies.

10. Content on this website

The content on this website, including text, photos, videos, graphics and logos, belongs to us or to the people who license it to us. You may view it for personal use and share links to it. Please do not copy it or use it for commercial purposes without our written permission.

11. Using our website

Please do not misuse this website, for example by trying to get unauthorised access, interfering with how it works, or using it for anything unlawful or fraudulent. We may suspend access or cancel orders linked to misuse.

12. Our responsibility to you

We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care, and for anything the consumer guarantees or your local consumer law make us responsible for. We are not responsible for loss that was not reasonably foreseeable. If you buy for a business, we are not liable for loss of profit or business interruption, to the extent the law allows. Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud.

13. Privacy

Our Privacy policy explains how we collect and use your personal information.

14. Changes to these terms

We may update these terms from time to time. The version on this website when you place your order applies to that order.

15. Governing law

These terms are governed by the laws of Queensland, Australia. If you are a consumer living in the UK or EU, you also keep the protection of the mandatory laws of your country and can bring a claim in your local courts.
